Duden was named as the leader of the Brazilian Lottery and Gaming Secretariat (SPA), and he will be in charge of supervising gambling rules in Brazil.
In the past week, the Brazilian Ministry of Finance and the Sports Betting Regulatory Agency (SPA) unveiled new rules governing gambling, specifically Normative Ordinance No. 615. These new regulations stipulate that operators are prohibited from accepting wagers via credit cards or digital currencies.
Brazil is currently in the midst of a four-stage regulatory implementation process, projected to be finalized by the end of July 2024. The initial stage, currently in progress, entails establishing payment, security, and technical frameworks.
The subsequent phase will involve the SPA releasing its policies on fraud, encompassing anti-money laundering and anti-terrorism financing strategies. The third phase will concentrate on advertising procedures, along with technical and security considerations. Lastly, the final phase will focus on how the industry can contribute to social responsibility initiatives.
Sports betting advertising will be subject to regulation by the Ministry of Finance.
Earlier this year in April, Brazil also declared that sports betting advertising must comply with the Ministry of Finance’s regulations.
The Brazilian Football Confederation (CBF) General Competition Regulations for 2024 stipulate that advertising must adhere to guidelines, such as prohibiting unauthorized operators from promoting their services.
Unfounded claims related to winning probabilities in advertisements are also prohibited, as well as marketing campaigns that portray gambling as a solution to financial difficulties or as a socially acceptable leisure activity.
Gambling operators are also prohibited from employing famous individuals or other influential figures to advertise their products.
